Who's at fault in a hit and run accident?

More details to this question:
I was driving home from work in the rain last night and there was an accident on the other side of the street. I got distracted by the police and ambulance lights and didn't notice that the car in front of me had stopped, and I rear ended the car. I tried to pull to the side of the road to make sure everything was okay, but that car sped off! I didn't want to follow it because the whole situation felt shady. What should I do next?

You were at fault for the accident itself but the other person committed the crime of leaving the scene of an accident.

If you are charged with a Hit and Run criminal citation FAULT is not the issue. It is the notion of getting into an accident with another vehicle or something and not contacting the owner of that property and leaving your name, address, phone number and insurance information.

Exercise your right to remain silent if an investigator calls. Don't volunteer info, especially info that puts you at the scene and will incriminate you no matter what you say.

They probably took off because they were driving without registration, or license, or insurance, or they had active arrest warrants. They didn't care that it was your fault, they just didn't want to talk to the police.
