In Colorado, using a bluetooth device is not illegal. But, some cops might not understand the law. The so called texting and driving? law is so broad that it seems to include changing the station on your car radio or simply answering your phone. I do not believe that was the intent of the legislature and I have not seen it enforced that way.

Probably not. There has not been much caselaw on this topic, as it is not specifically outlined in the anti-texting legislation that passed some time ago. The important thing to keep in mind is to not have your actual phone in your hand or on your lap. This seems to be the general consensus in the state of Michigan but you will also want to look into whether there are any local laws where you are driving that cover this subject matter.
