I was in jail for 18 days. I had 19hrs of ot from the 3rd and 4th of Nov. I ended up going to jail Nov 5th. According to my former employers records I was terminated Nov. 7th. I got outta jail Nov. 23rd which was a sun. Nov 24th 7:01am I was calling to find out why I haven't been paid. I was told I'd have to wait for them to verify I did indeed work the 19hrs. While I was in jail my wife was in constant contact with them informing them I haven't been paid. My former employer is temp agency and they informed my wife she needed to get in contact with the shift supervisor on the shift I work and have him verify with my employer that I indeed worked. I served them both a demand for payment firm and small claims notice. This was all done on the 25th of Nov. They've since set me a check for what was originally owed. Would I lose if I were to cash it?
I don't understand. You say that the check is for what is owed. Thus, you have no damages remaining to win your suit on.
Even if you are owed more it is unlikely that cashing the check will have a negative impact on your case but it is impossible to determine for certain without seeing the check and fully understanding the facts.
