WCC Case: Original Attorney withdrew with a $800 lien attached. My new attorney pickup the case and got it settled. The checks where sent to the attorney that withdrew from my case. Two weeks later she returned both checks unsigned and she refuse to sign off on my portion that has nothing to due with the attorneys fees and she also refuse to sign the check that her payment will come out of. What can I do. This attorney withdrew from case after I informed her that I found out that she took a back door offer without informing me. If she took the funds before my case settled and does not want this to come out it appears that this is her reason for the hold up on signing off. What other reason would she have not get paid. My attorneys have agreed to pay her lien amount, but she now refuse to respond. What can I do ?
Your new attorneys can send the old attorney a check for the lien in exchange for her endorsement on the settlement checks. If the attorney does not respond to this, a bar complaint can be filed for her failure to respond and delay of your case. Your current attorneys may have other ideas.
