I am a full time teacher and this PT assistant is also a full time teacher. I have been taking sick time because of an illness and he used my present health information to have me voted out of a union post by telling colleagues that I may be out for an extended time. I was in the hospital a couple of weeks ago and he works for the physical therapy unit for that hospital. I also use Doctors and services from the same hospital. Not sure where his information on my health came from but it is public record that he nominated the person who replaced me. I am out on total disability for the remainder of the school year. Do HIPPA laws apply here? He is also the athletic trainer for the school district.
Yes, the HIPAA Laws protect dissemination of your health information by your providers. You may want to contact NYSDOH to inquire about filing a complaint. Hope this helps. Jeffrey M. Rich, Esq.
