can i file medical malpractice case how much are damages

More details to this question:
my son was diagnosed with peripheral neuropathy (foot drop) after appendectomy. he felt the needle so he jerked. it's been 20 days since operation. there was also delay of diagnosis. the surgeon didn't administer proper rounds procedure. he showed himself at the doorstep of our room carrying his son in his arms and told my son that he can already walk. then he left. that was the day after his operation and the nurses failed or wasnt able to contact him about my son not being able to move his right foot. accdg to my son he was not given topical anesthesia before injection of spinal anesthesia
