Ankles fractures can fail to heal for a variety of reasons, and so it is not a foregone conclusion that this was the result of medical malpractice. You should certainly get a second opinion about this, because frequently when a bone fails to fuse a reoperation is necessary. If you get a second opinon, this may also shed light on why the bone is not healing and give you a better idea of whether you have a malpractice claim that should be investigated.
