Can i sue?

Obviously if a doctor is telling you that the first surgeon was negligent, you have good reason to be suspicious, but in my experience, when this occurs, this is not necessarily the last word on things. Many doctors will critique the job of a predecessor with 20/20 hindsight and without a full understanding of what the standard of care is.  There will be a question about whether the case is financially viable. How much damage was caused by the negligence of the first surgeon, and what part of that damage is irreparable?  If you want to investigate a case further, you should contact a local medical malpractice attorney (one in your state).  They take these cases on a contingency basis which means you only have to pay if you succeed.  Additionally, initial consultations are usually free.
