Can I sue for broken hardware in my ankle?

More details to this question:
I broke my ankle in March of 2021, I had surgery in early April. By September I was having a second surgery because one of the screws came out. The second surgery involved a Titanium plate with 4 screws. Now the titanium plate is fractured in to two pieces and 3 of the 4 screws are either broken or not in the original position. I have extreme swelling in my ankle and the surgeon suggests that my only option is to live with the discomfort or fuse my ankle bones together which would prevent ankle movement.
