QUESTION

Can nurse bad mouth a patient?

Asked on Sep 12th, 2014 on Medical Malpractice - Florida
More details to this question:
The nurse treating me at my current dialysis facility was not acknowledging the fact I was getting heart palpitations and attacks because the drugs being administered to me. I refused the drug a few times to investigate myself. The issues stopped but I decided to try the drugs again since she insisted I take them and once again by the second day of taking them the issues occurred again. The next day I refused and she got argumentative so I also got argumentative and told her to do her job and find out why I am having these issues and words were exchanged. I had them disconnect me from the dialysis machine and walked out. I tried to go to another facility but they did not accept me. Months later I find out I was because she relayed information regarding our confrontation. That has nothing to do with my medical history and she had basically did that so the new facility would refuse to take me. Is that legal?

If a healthcare provider deems you antagonistic or combative, this is likely part of your history, and may well be conveyed. If you can show that it was to keep you from getting care elsewhere, which is likely very difficult to prove absent the new facility putting this is writing, there might some other issue. If you have further questions or concerns, please feel free to call our office at 1-800-922-6442 for a FREE consultation.
