My husband was born with nf1 he has a large tumor on the left side I his face the size of a softball sticking out. It began to bother him causing pain, we went to our local hospital and we told them he has nf1 and that it is a tumor. They walked in did not look at or touch or exam the tumor and said its a cyst it'll go away about 6 months later he had surgery elsewhere findin out it was cancerous now the cancer is throughout his body. We feel the doctors could have done something alon time ago if they had pulled his file but they didn't. Also looking at his medical record the doctor put no dictations or signatures on it. What should we do? He wants to sue, is this a medical malpractice case???
It could be a viable medical malpractice depending on the specifics of the tumor at the time it was originally seen. The standard of care may have required the physicians to perform a pathology work up of the tumor and/or a CT scan to determine if it was cancerous. The other important question is what effect this delay had in his treatment and prognosis. We have handled several of these claims and would be happy to discuss the case in more detail with you.
