Daughter had unnecessary hernia surgery

More details to this question:
I took my 7 yo to Albany Med for a hernia surgery. The doctor said she had an umbilical hernia. Performed the operation and her bump was still there. I showed the doctor and she said she never saw that bump and didn't know what we were talking about. She claims to have performed an umbilical hernia repair. I took my daughter for an ultrasound of the bump. She has another hernia that needs another surgery. I don't believe the doctor found a hernia. I believe she faked the surgery for money. And did not perform the surgery we had brought our daughter to her for.

Assuming this happened less than 2 1/2 years ago, you might have an action for medical malpractice if you can prove, based on your daughter's medical records from before the first surgery, that the first hernia was the same hernia as the one that was allegedly removed by the first surgeon. You'd need a surgeon's testimony, based on a review of your daughter's records, in order to prove this.
