QUESTION

Do I have a case?

Asked on Jan 04th, 2022 on Medical Malpractice - Ohio
More details to this question:
I had a a full ankle replacement surgery on 8/4/2021 through Ortho Cincy/Wellington Surgeon Dr. John Linz at Christ Hospital in Cincinnati, Ohio. I had a full physical and blood work prior to surgery and have NO health issues. I am a teacher so I wanted to have this surgery done so I was able to return to teaching in 6-8 weeks. I returned to the office approximately 3 weeks later to have the splint and my 30 some staples removed. When he took off my splint I had 2 severe pressure wounds from the splint being to tight. My heel was totally black and the very top of my foot was a large pressure wound. I have had to have several debridements by the surgeon. He finally told me he could not help me anymore that I should see a Wound specialist. I have been seeing a wound doctor weekly as well as Hyperbariac Oxygen treatments daily to try and save my foot. I have not been able to walk, work, drive, or perform any self help skills without help. My husband has had to miss work to care for me.

Ah yes, I know Wellington.  Based just on the information provided, it sounds like your surgeon was negligent in bracing your ankle after surgery.  You can sue a doctor for negligence.  A number of factors could affect the value of your case including: whether you followed the surgeon's post-surgery instructions, whether you have diabetes or another condition that could affect healing, whether the doctor took your condition into consideration when providing care. Your next step is to get your medical records from the surgeon and the doctor who performed your surgery and the doctor you have been working with since your surgery.  I generally collect medical records for my clients, but medical providers are particularly slow in responding to lawyers right now.  I find the patients can obtain records faster. You should also discuss your case with a lawyer. Kimberly Beck Beck Law Center 201 E. 5th Street, Suite 1900 Cincinnati, OH 45202 kim@becklawcenter.com 888-434-2912
