More details to this question:
I had bariatric surgery doing my initial surgery the doctor saw I had a hernia, but did not repair. After 7 days of vomiting 2 and 3 times a day, I became extremely ill and had to be taken back to surgery. The surgeon found out my intestines has twisted and went into the hernia. He repaired the hernia and untwisted my intestines. Besides havening another surgery, my protein level had drop to low and I needed high doses of protein.

Did he offer you some kind of reason for why he failed to address the hernia during the initial surgery? If accepted standards of care required him to deal with the hernia, then you may have a medical malpractice case, although the question will be whether it is financially viable if the second surgery cured all of the problems.
