QUESTION

Do I have a case?

Asked on Feb 15th, 2014 on Medical Malpractice - Florida
More details to this question:
I am currently on home confinement from the BOP. I had heart surgery while incarcerated on July 31, 2013 for sparing of the aorta, and repairing the mitral valve. The Dr. retired a matter of weeks after, so I had 1 follow-up apt with him 1 week after surgery. In this visit the Dr advised I had a minor regurgitation in my aorta valve and would need to monitor it twice a year. I was released to the halfway house 9/26/13. I requested approval to see a cardiologist here to follow-up and requested medical records from the Drs office that performed the surgery. After receiving the records I noticed the Dr wrote in his report I have "moderate to severe" regurgitation in the aorta valve. My cardiologist here requested a TEE test. It resulted in them referring me to a surgeon as I will need to have surgery again to replace the aorta valve with a mechanical one. The BOP is now wanting me to return back to prison to have surgery. I don't want to leave my family, I just want it paid/done here.

No offense, but if your not paying for the surgery out of YOUR pocket, you may not have lots of choices when its getting paid for by the government. Not sure what you mean by "return to prison" by I assuming they meant temporarily.
