Do I have a case?

More details to this question:
Back in May I went to the ER with severe knock pain. I did not and don't have medical insurance. From the get go my concern was not taken into consideration. Test after test was done with no one asking for an approval. I am now stuck with 80k in bills and am still having severe neck pain and don't know what to do. I feel that if I agree to any sort of payment terms I am stuck and have agreed with the entire collection of bills. Do I file a BK or a malpractice lawsuite.. Does a BK affect me and my wife? Would she lose her vehicles? Can a BK be filed in just my name and not involve my spouse?I simply don't know what to do or where to turn.

From your description of your situation, there is no apparent medical malpractice but you do ask good questions regarding the consequences of filing for bankruptcy.  You should speak with an attorney that handles bankruptcy matters for accurate information as to your legal options.
