Do I have a case for medical malpractice

More details to this question:
Husband was injured at work. The urgent care facility took an xray, saw that he had a broken heel, splinted him up and sent him on his way, telling him he would receive a call the next business day to follow up with an orthopedist. The open wound at the back of his foot is not healing, and 1 month later has been diagnosed with MRSA. I feel that more should have been done immediately after the accident to treat the open wound

The issue may well be whether your husband followed up with anyone after he went to the urgent care facility. It is very difficult to determine when the foot became infected, but you are correct, it certainly should have been treated. Your question seems to imply that your husband may not have seen anyone for one month. If that is true, his case would be most difficult.
