QUESTION

Do I have a case of malpractice or negligence

Asked on Nov 13th, 2014 on Medical Malpractice - Florida
More details to this question:
My wife went to prevent from getting pregnant, and the Dr told her she was already pregnant which in fact she wasn't. She went to a different dr and had a sonogram done and found out she was six weeks pregnant which would mean she got pregnant two or three weeks after the first dr claimed she was pregnant. Do I have a case since she went to prevent becoming pregnant because we're not ready for another child and she was misdiagnosed.

No. For a variety of reasons most obvious reason being that there would be no damages, second because the timing of the issue and the odd gap of 9 weeks between doctor visits with second opinion suggesting other issues that may affect a liability claim.
