Do I have a case when a doctor admits a mistake but does nothing about it

More details to this question:
Unilateral frenetic nerve damage occurred durning ablasion surgery of the sinus mode of my heart paralyzing my diaphragm. Dr admitted it was a mistake and "could" get better over time 6 months on and i must carry oxygen with me everywhere
