Do I have a malpractice case?

More details to this question:
2/7/2017, surgery to correct a deviated septum. on 2/21 my nose began to bleed;4 hours in the ER, bled out over 2 units, sent home with inflatable packing inside my sinuses, ENT dr at ER stated it should stay in for 3-5 days. (excruciating) 2/23, my ENT wanted to remove packing before weekend. stated arterial bleed was in an area where he was not working, but that he can't deny the 'temporal connection', agreed it was possible that he caused the damage, but the swelling held the artery closed for 2 weeks. assured me that if i started bleeding again he would meet me at the ER to correct surgically. 8 pm, burst again. back to ER, face repacked, no response from my ENTs cell. ER to send me home. Dad called ENT office, still no answer from my ENT, but colleague came, emergency surgery; cauterized artery and had to cut into sinus to permanently clamp. nerve damage, 24/7 pain permanent, recurring nightmares. 2nd opinion agrees to time connection and damage/swelling theory.

In my oppinion, I do not see a med mal case.  From my understanding, what you have experienced are possible risks of the procedure. Unless you have a second medical doctor who will attest and put in writing that the surgeon did something outside the normal course of business that resulted in your injuries, a case is very unlikely.  That being said, I think you should still consult with a medical malpractice attorney with experience.
