I had a accident and broke my tibia bone in nj, The ER DR''s put a temporary splint on my leg while they tried get a hold of the orthopedic DR which is an outside DR that handles orthopedic issues in that hospital, The DR told the ER DR''s to dismiss me 2 hrs after accident because i didn''t have any medical coverage. The ER Dr''s faught with the guy and they held me over for the following day the orthopedics DR showed up the following day, Left me in the splint and discharged me i told him that the split is temporary and that i needed a more permanent cast he said he can''t do nothing because he can''t do nothing in the hospital and i would have to go to his office to get a cast put on, 3 months later my leg looks swollen but it''s not it''s that my bone isn''t aligned right and it seems like only 50% of the bone is contacting the lower part and the rest is just having over so now i can barely walk and it hurts like crazy to walk. I think tibia bone require a rod and screws
It appears that you may have a legitimate complaint against the hospital and/or the orthopaedic surgeon. These type of fractures require an open reduction with internal fixation in many circumstances. The failure to perform this type of procedure initially can result in a non-union of the fracture, a more dramatic surgery to rebreak and set the fracture, and permanent pain and disability. The merits of your claim can only be determined by having another orthopaedic surgeon review your medical records and x-rays to see if the standard of care has been breached. I would contact an attorney in your area as soon as possible to investigate this claim on your behalf.
