QUESTION

Do I have a malpractice case?

Asked on Jul 04th, 2014 on Medical Malpractice - Florida
More details to this question:
In short, I have a history of heart issues (congestive heart failure, DR was aware of this) and wasn't feeling well one night so went to the ER complaining of vision problems, memory loss, severe headache, etc. and was sent home by the DR stating it was just a toothache (had dental work done previously) so left ER. Days past and still wasn't feeling well, vision worsened (was now blind in right eye), still had headache, etc. so went back to ER. This time anther DR ran test and said that I had suffered a stroke. Now blind in right eye, brain damage, memory loss, etc. and finding it difficult to work and/or find work and was curious if I may have a malpractice case?

It sounds like you may have a viable malpractice case because complaints of visual problems, memory loss and severe headaches should cause a stroke to be in a doctor's differential diagnosis. The question in the case will be how different the outcome would have been if you were timely diagnosed.  If you want to investigate a case, you should contact a local medical malpractice attorney (one in your state).  They take these cases on a contingency basis which means you only have to pay if you succeed.  Additionally, initial consultations are usually free. You can use the "Find a Lawyer" service through this website to research medical malpractice attorneys.  Then, visit each attorney's website and look for a firm that has a record of successful verdicts.  Below are some articles you may find helpful.  They are written for a New Jersey audience (where I practice) but the ideas discussed in these articles usually apply in most other jurisdictions as well. I will do nothing further to protect or preserve your interests in the absence of any additional discussion with you about this matter. John Ratkowitz, Esq.
