Do I have a malpractise case?

More details to this question:
I went to the ER at Aurora Hospital in Burlington with diverticulitis pain. I was already being treated with antibiotic and oxicodone for pain but obviously it was not working. I was told to continue my current treatment. The doctor seemed disinterested to say the least. A month later I had surgery and a colostomy. My surgeon told me I would have been dead in a week due to the massive infection. I went home after two weeks in the hospital with a colostomy bag and large open wound. My surgeon told me if they had admitted me when I went to the ER, I would have had surgery, but no colostomy or open wound. I lost my job and was in painfor two months. I also became addicted to my pain medication.

If the surgeon is correct, then you probably have a medical malpractice case worth investigating, although there will be a debate in the case about whether successful intervention would have avoided the outcome because at the very least, you already had an infection that was apparently resistant to antibiotics.  If you want to investigate a malpractice case, you should contact a local medical malpractice attorney (one in your state).  They take these cases on a contingency basis which means you only have to pay if you succeed.  Additionally, initial consultations are usually free.
