Do I have a medical malpractice case ?

More details to this question:
I had back surgery/spinal fusion @L5/S1 on 07/11/12. My surgeon nicked my dural sac during my surgery, he repaired it with sutures during my surgery. The surgery has left me with numbness on my right side from my private area, buttocks to the backside of my right thigh as well as the outside of my right foot along with two toes which is constant. The left side i have numbness in my left buttock and left thigh ( just started since i started physical therapy in may ) but the outside of my left foot and one toe is constant.I have sharp shooting pains from my waist down to my toes everyday i also still have pain in my lower back along with burning. It has been hard to walk sit and stand for long periods i can't handle more than 1 1/2 hrs. before i have to change positions,driving is a challenge and sleeping is horrible. I am up at least 3 times a night. Sex with my spouse has decreased and our marriage has suffered. I haven't been able to work since and my job of 18 yrs, just let me go.
