Do I have a win-able case?

More details to this question:
My wife injured her foot at home. She went to our local hospital outpatient ER. They took Xrays that showed broken metetarsel bone. Copies shown to us on TV screen showed the break. Xrays not available for 2 days. We went to a local orthopedist. We showed him the photo of an xray that showed the broken bone. He said it would heal by itself and to just keep off it as much as possible. See him again in 3 weeks. He said for her to wear a hard soled show, like a sneaker. HE TOOK NO XRAYS!!! Pain persisted so we went to a surgical podiatrist. HE TOOK XRAYS that showed several broken bones. He advised surgery, which he performed. Wife has a pin Wife thru front of toe that holds surgical repair in place. She . We asked the first MD for her records of our visit. We saw that he said HE TOOK 3 SETS OF XRAYS. HE BILLED MEDICARE FOR THE XRAYS. HE TOOK NO XRAYS. HIS DIAGNOSIS WAS BASED ON A GUESS!!! Wife still in wheelchair 5 weeks latet.

There is likely no malpractice claim described, unless there is evidence that he caused the added fractures by misdiagnosis or some significant harm. It does sound like you may have a complaint to the board medicine and Medicare for medicare fraud and you should report both ASAP.
