QUESTION

Do I have grounds for a lawsuit?

Asked on Jan 26th, 2013 on Medical Malpractice - Missouri
More details to this question:
I got a Mirena IUD after I had my son and I've been experiencing several of the side effects that the product information tells me mean I should contact my doctor, but whenever I call the doctor's office, I end up talking to a nurse who tells me that it's probably nothing and I need to just take some ibuprofen and I'll be fine, so I can't even get an appointment to see the doctor or talk to him anyway. When I was pregnant, the nurses in the office all badgered me repeatedly about getting a mirena after I had my baby, talking up the good things about it and telling me that there were some side effects, but they were so rare it was unlikely that I'd experience any of them. They really talked up the idea that the device would all but stop my period, and all it's done is make it a hundred times more irregular. When I'd ask about the possibility of it causing infertility later, they basically told me that was so unlikely it wasn't worth talking about. Can I sue the doctor or hospital?

I think it is a little premature to be contemplating a lawsuit. Go to another OBGYN and get a second opinion and see if there is something that can be done to cure the issues you are having. If so, you probably do not have a financially viable case.
