Checked-in to hospital for 'corrective' spinal fusion, per recommendation of orthopedic surgeon, with rods, and to cure associated left knee pain. Walked in with cane. After 13+hrs in O.R. I was declared FULL CODE with renal failure beginning, then transferred to ICU on ventilator. Moved to 'time will tell' ward after 2 days. After being removed from ventilator, staff tried to get me out of the bed and failed to handle me correctly almost dropping me onto the floor. After 2 weeks transferred to physical therapy facility; totally unable to walk.. At some time, the rods separated from upper spine. Rods still protrude! Pain in knee is worse causing severe impaired mobility. Discharged from therapy after approx. 23 days in FAIR CONDITION! Received in-home PT for several weeks primarily to improve leg strength and mobility. I still need to use a wheelchair and walking-frame.

It's tough to say whether there was medical malpractice without looking at the records to see what happened. There are a number of things that could have gone wrong which range from doing unnecessary surgery to cutting a vein or artery and causing a bleed to causing a severe infection. If your doctors have not given you an explanation for what happened, I would certainly ask them for an explanation. At the end of the day though, the only way you are going to know is to have someone look at the records and make a determination as to what happened. You only have two years to pursue a case in Texas and it can take quite awhile to figure out what happened so you should not delay.
