Do I have grounds for a malpractice case?

More details to this question:
I've had 2 successful joint-fusion surgeries performed on different fingers by the same Doctor. However, in this 3rd (last) surgery performed Nov. 2020, the Doctor decided to fuse the joint on my 3rd finger at an angle - not perpendicular). .Basically, he altered the procedure and now, as a part-time Musician (Percussionist) I have discomfort (pain) after I play. When I presented the issue, he downplayed it.... I was not happy! I would rather get the problem resolved by the Doctor at his cost but not sure that's a feasible solution... and therefore, I'm asking the question.

In order for you to have a med mal case you need to be able to show that the opperating doctor went against standard opperating procedure or in some way did not meet the standard of care. You must also show what the reqired standard is and how it was deviated from and that their is a causal connection between the deviation and the injury.  The way you prove this is by getting a sworn statement or testimony or affidavit from another medical professional in a substantialy similar practice.  Please feel free to contact us for more information or assistance 203-870-6700.
