More details to this question:
my daughter Rylee Medrano passed away February 10, 2013 she was born December 27, 2012. we took her to the er on the 10th because she had a fever. she was given 250mg of rocheprin. after the injection she started to grunt we she took a breath. i had the nurse get the dr and he said it was he stomach contracting to go home and give her gas drops. she had a fever of 102.6. we took her home and when we got her from the carseat she was limp. we got back in the car to go back to the hospital when she stopped breathing. we stopped at a fire department where they tried for an hour to get her back before taking her to the hospital to call her time of death. the coroner says her cause of death was sepcis causesd by gbs. i tested negative 3 times while i was pregnant. i truly believe she had an allergic reaction to the medication she was given at the er.when we got her toxicology report back benedryl showed up in her system and ladicaine but not what the er gave her. its very confusing.

In response to your question, you may have a case, but there is not enough information to know.  If she had gbs, she may have had meningitis, which is treated with rocheprin.  However, if your child had meningitis, she should not have been sent home.  Please give me a call if you would like to discuss this further and see if there is a case here.  My number is 843-822-9800.
