does a contracting a hospital infection constitute injury?

More details to this question:
I had surgery on 08-01-18 the incision began to drain puss in 08-08-18 I was re admitted to the hospital and discharged on 08-10-18. I was going to the doctor 3 days a week for him to clean and check the wound. On Thursday August 30 for an office visit the doctor told me to report to the hospital to be admitted because the wound was still infected and now had begun to produce more puss. was discharged on 09-04-18. now a nurse come to the house and i continue to report to the doctors office twice a week. I have more detailed information if you need it.

Good afternoon - So sorry that you are going through this. Unfortunately, infenctions following surgery is generally considered an unavoidable complication. In order to prove malpractice of negligence, you would need proof that the medical team or staff carelessly exposed you to infection, used a dirty instrument or did something to expose you to the bacteria/virus. This is often impossible.  If you have some information or proof of such carelessness, then the next question would be the extent of damages. Wishing you a speedy recovery! Jack Giordano
