Does my son have a viable case for medical malpractice?

My son presented to an ER with a history of vomiting for 2-3 days, inability to keep anything down, and sore throat. No testing was done. He was diagnosed with reflux, given medication to soothe his throat, a prescription for prilosec, and sent home. The next morning, he presented at a different ER with the same symptoms. Testing revealed a blood sugar of 799, blood Ph of 7.06, sodium level of 117, and pancreatitis. He was told that if he came in any later he would have been dead. He spent 5 days in the ICU on an insulin drip.

A misdiagnosis of one day that does not result in any additional damages is usually not the basis for a medical malpractice lawsuit.
