QUESTION

ear wax removal injury

Asked on Feb 13th, 2013 on Medical Malpractice - Washington
More details to this question:
injured during ear wax removal session, that started out with couret ( hard plastic instrument) , instead of starting with water irrigation, and I was injured. I later got the administration MD of hospital to admit they should have started with water. I went to new doctor a new hospital, he did not even try, and sent me directly to ear nose throat specialist. ADMIN md of hospital; where injury took place asked me 'what they could do for me' instead of offering to pay my bill at new hospital ( because I had no intention of going back to them, obviously), but nothing was offered ( I shall send a letter, and case is being looked at supposedly by state md board ). I knew I was injured wrecklessly , because during session I was injured ( hurt very much) and said as much twice. The specialists office also clearly said MD's usually do/should 'err on side of caution' and send clients to them for safer extraction of wax, and that was not done.

The issue is will be what the injury was from the care and whether it can be fixed. If so, you probably do not have a financially vaible malpractice case.  Medical malpractice cases are very costly and time consuming for lawyers to pursue, and in most circumstances attorneys will not take them on unless a patient suffered a significant permanent injury that causes substantial disability as a result of the medical mistake.  Below are some articles you may find helpful.  They are written for a New Jersey audience (where I practice) but the ideas discussed in these articles usually apply in most other jurisdictions as well.
