Failure to properly treat or diagnose a stroke

More details to this question:
My dad had a sudden loss of partial vision while driving about 4 yrs ago. The next day I took him to the eye doctor he told us to return to him the next day. We went and he did some tests and sent us to the emergency room. The hospital kept him overnight for observation. The next day one of the doctors told us he could go home because he couldn't find anything wrong. Within a few hours of coming home he had a major stroke that has left him unable to control his right side of his body. We found out later from other doctors that my Dad did not get the proper testing he should have gotten while in hospital that may have helped know the next stroke was coming. He should have been kept in the hospital not sent home. Do you think we have a case and is it too late if we do?

Ms. Fant, The only answer I can give you without reviewing the records is that it depends on several things that would need to be investigated in the records. However, in Illinois you have 2 years from the date that you knew or should have known that malpractice occurred causing injury and no more than 4 years from the date the malpractice occurred causing injury. Therefore it appears from the facts given ( 4 years ago) that you are barred from filing suit because the Statute of Limitations has run.
