More details to this question:
My grandfather was living at an alf and fell. He was complaining of head and neck pain. He was coherrant and was able to help somewhat back to bed. I tooknhim to the Dr. the next morning. He was in a lot of pain in his head and neck. Was unable to turn neck beyond an inch or so. He was able to walk with his rolling walker but needed help getting up due to pain. When his physician came in the room he just stood over him asked what happened, told him, and he then told me that he did not feel the injury warrented anytests because if he had a bleed on his brain that he was not a candidate for brain surgery. I asked what about the neck pain and he said well his neck is strained and I will order some pain med for a few days and he will be fine. He never once touched my grandfather or even asked him how he was. When he left the room my grandfather said well, that was a wasted visit. This was on Monday, August 11. Throughout the week he was not getting any better. Could not sit up by himself

The issue here is determining what the misdiagnosis of fx C2 vertebra caused as far as additional injury or harm and what could have been done differently given the age and condition of the patient. From a civil perspective, there would need to be more than a termporary abilility to sit up.
