QUESTION

Getting Medical Records....??

Asked on Apr 19th, 2016 on Medical Malpractice - New York
More details to this question:
I am the domestic partner of the plaintiff who died because the surgeons failed to recognize the severity of her condition, sepsis. Because we were not married and had no will I can't get her medical records without going through the surrogate court for Schenectady county. Is there any easier way to get her medical records? I need to become her administrator for her estate. She has sever blood relatives that all agree that I should be the administrator. What would you recommend to get the ball rolling. It's been almost 10 months since her death.

If the blood relatives sign off on you becoming administrator that would enable you to obtain the records.  You can also get temporary letters of administration just for the purpose of prosecuting the medical malpractice/ wrongful death action.  I would try to find a local estate attorney to help you with the surrogate work.
