how do you prove medical malpractice?

More details to this question:
my boyfriend has 3 broken vertibras in his neck and the doctor at the hospital put a halo on his head and now we found out that he did not need it he only needed a neck brace because of this halo he now will have scars and bumps or what they call horns growing out of his head , he has suffered alot of pain and alot of medical bills

As a starting point, you need to determine whether the treatment provided by the hospital fell below acceptable standards of care.  This is a determination to be made by an expert (i.e. a doctor specialized in the injuries/treatment at issue).   Simon W.
