If the harm was the result of a mistake in prescribing the drug then two years from the date of the negligence. There are exceptions to that rule, but that is the general rule. You have a longer period of time if you are claiming that you were harmed because the drug was inherently defective (that is a products liability case).  If you want to investigate a malpractice case, you should contact a local medical malpractice attorney (one in your state).  They take these cases on a contingency basis which means you only have to pay if you succeed.  Additionally, initial consultations are usually free.
