Is it medical malpractice or professional neglience?

More details to this question:
Went in for a heart ablation for A-fib. We made our doctor promise that he would be the only one to do this procedure. We told him because it was a teaching hospital we knew sometimes others did the procedures. He promised us that only he would do the procedure. He said he was the only EP there. In the meantime his practice hired another EP and our doctor allowed the new doctor to perform the procedure. In the process her punctured the heart requiring the chest to be opened to repair the hole. In that process they puctured in the groin once in the vein and twice in the artery requiring another surgery because of developing an AV Fistula and a pseudo aneurysm.
