is this malpractice?

More details to this question:
I had an operation at Brandon hospital. it was a hysterectomy. the mistake was it was written up as a day surgery. i was sent home against my will and that night i fell down and popped a hole in my kidney and ruptured my pancreas it took 9 months of recovery with a chicken broth and jello diet. i did not know they had it written up as a day surgery until a few months ago. i was very sick for a very long time. i am just now recovering enough to relies what happened. the hospital took a $2,480.00 deposit and my insurance paid the rest. the hospital has been charging me and taking $40.00 a month out of my bank account since AUG. 2010 for this situation. I have a learn disability and it took me this long to figure out this was happening. do u think i have a case?
