Is this medical neglince?

More details to this question:
I stepped on a sewing needle that broke off in my foot. I went to urgent care an they sent me to the ER, the ER doctor took x-rays and told me the needle was NOT in the bone, then refused to remove the needle stating that "he was not licensed to cut" and "that he did not have time to go digging around in my foot looking for it." he recommended an orthopedic surgeon that liked to do that kind of thing. I was sent home.

You would expect that an ER would be equipped to deal with the problem, but presumably you went elsewhere and had the needle removed.
