Lost Great Toe - Do I have a case?

More details to this question:
I scrapped the bottom my toe. It did not break the skin. Blood pooled under the skin. About 3 weeks later a big chunk of tissue fell off under where the blood was. Went to ER- they were more concerned about my high BP than my toe. They knew I was diabetic yet they did not take xrays or run blood cultures for infection. They put a band-aid on it literally and said to follow up with a surgeon. Surgeon said it looked fine and didn't need to see me again for two weeks. 3 days later I was back in the ER - different hospital- due to most of the skin on top of my toe falling off. They found that I had a raging bone infection that had most likely been there for weeks and the infection actually fractured the toe. Long story short, 8 weeks after initial visit to ER they had to amputate my toe. Do I have a negligence case against original hospital/surgeon?
