QUESTION

Malpractice or personal injury

More details to this question:
I was diagnosed as having " Parkinson like symptoms" then was put on medications for Parkinsons, leaving me without the ability to walk without a cane , unable to drive my car or even speak normally. I did not have Parkinsons like symptoms and was advised by another dr that I was being heavily overmedicated. I took myself off of all the medications I had been on and within 2 weeks was back to my normal self. he also told me that an MRI/MRA of my brain showed that I had had "multiple mini strokes" . I show no signs of that nor did I ever. The only test results that he shared with me was a sleep study and the MRI , which I did not know what I was looking at . He then gave me a form to get a " disabled" sign for my car and also told me to file for my SS disability. I did both and was approved for SS disability , but by that time I was fine and refused it, explained to SS what had happened. I feel like not only was I misdiagnosed , but he fraudulently filed out paperwork for disability.

It sounds like you have reason to suspect that you were the victim of negligent care, but the question is whether the case is financially viable. If you were only temporarily disabled and the delay in diagnosing the strokes did not result in permanent harm, you probably do not have a financially viable case. The articles linked below discuss this in more detail.  If you want to investigate a case, you should contact a local medical malpractice attorney (one in your state).  They take these cases on a contingency basis which means you only have to pay if you succeed.  Additionally, initial consultations are usually free. You can use the "Find a Lawyer" service through this website to research medical malpractice attorneys.  Then, visit each attorney's website and look for a firm that has a record of successful verdicts.  Below are some articles you may find helpful.  They are written for a New Jersey audience (where I practice) but the ideas discussed in these articles usually apply in most other jurisdictions as well.           Click here for an article that discusses the three main questions I ask when deciding whether to investigate a potential medical malpractice case. This discusses the issue of financial viability. Click here for an article that explains what you can and should expect when pursuing a medical malpractice case.
