QUESTION

Medical malpractice?

Asked on Sep 18th, 2017 on Medical Malpractice - New York
More details to this question:
I had a colonoscopy done in March 2017 two days later I began to bleed so much that I was admitted to the hospital for 2-1/2days. I came home anemic and low blood pressure which I had to take supplements to try and bring my system up (I still have to take iron) It seemed the GI doctor could not give me a clear explanation as to why this happened. The GI doctor did remove a polyp so I'm assuming he did not close up the incision correctly. I went to a different GI doctor to follow-up on what happened and to do another colonoscopy. This GI doctor performed a through exam and went our of his was to stay with me as long as it took to take care of my colon, he removed 6 more polyps and I have to go back in a year for a follow-up. I personally feel the first GI doctor procedure was pure negligence

In order to determine whether your first doctor committed medical malpractice, your colonoscopy records need to be reviwed by another doctor- and the best place to start is the second doctor.  I am curious what kind of doctor performed the colonoscopies- it's best to have it done by a gastroenterologist, but sometimes general practitioners or general surgeons do the procedure, as well.  A colonoscopy is a diagnostic test and if necessary, surgical procedure. Any polyps that are found can be removed during the procedure. To prove medical malpractice you need to prove that the first doctor made a mistake or omission and in doing so violated the standard of care for his specialty, and that this mistake was the proximate cause of your injuries, which were 2 1/2 days in a hospital, and a second colonoscopy. It sounds like the first doctor botched the polyp removal, causing your bleeding- there wouldn't be an incision- but the second doctor- or any good gastroenterologist- is the best one to explain what might have happened, after reviewing your records.
