my wife was under going neck surery when she woke up during surgery now her neck is stiff is this medical malpractice what should we do?

It is difficult to answer your question based on the facts that you provided. If your wife was undergoing cervical spine surgery she could have certainly been left with a stiff neck in the absence of negligence, so I would not think that stiffness alone compels a conclusion that your wife received negligent surgery.  If you want to investigate a malpractice case, you should contact a local medical malpractice attorney (one in your state).  They take these cases on a contingency basis which means you only have to pay if you succeed.  Additionally, initial consultations are usually free.
