QUESTION

neglected treatment by hospital

Asked on Jul 12th, 2013 on Medical Malpractice - California
More details to this question:
I stayed in St. Jude hospital for 10 days due to acute pancreatitis. However, even after discharged from the hospital, I still had pain and after checked with MRI, the pain was related with Pseudocist. When I was in hospital, we requested to do the check with MRI but the doctor told us that we don't need to do it. After suffered almost 2 months now, I am so mad at the doctor and the hospital's neglected treatment. Is there any way to sue this hospital being irresponsible treatment to the patient.

I am not certain I completely understand the facts, but it sounds like they missed a pseudocyst that was in the MRI films and if they had not, you would have had the problem taken care of ealier and avoided two months of needless suffering. If that is correct, you probably received substandard medical care, but if your damages are limited to two months of pain and suffering, you are going to have a hard time finding an attorney to take on the case because it is probably not financially vialble. The articles below spell that out in detail. If you do want to try and pursue a case, you should contact a local medical malpractice attorney (one in your state).  They take these cases on a contingency basis which means you only have to pay if you succeed.  Additionally, initial consultations are usually free. You can use the "Find a Lawyer" service through this website to research medical malpractice attorneys.  Then, visit each attorney's website and look for a firm that has a record of successful verdicts,  ideally with experience in cases that involve your medical issue. If you are unable to find a lawyer who meets these qualifications within your state, sometimes you may contact an out of state lawyer who can refer you to a qualified attorney in your state while providing support related to the issues of medicine. Below are some articles you may find helpful.  They are written for a New Jersey audience (where I practice) but the ideas discussed in these articles usually apply in most other jurisdictions as well.
