QUESTION

Negligence

Asked on Aug 20th, 2013 on Medical Malpractice - New Jersey
More details to this question:
I would like to explore the possibility of a lawsuit against a Doctor who was negligent in programing a Baclofen pump. On Thursday, August 15th, her Doctor at Lincoln Park Rehab was alarmed. Sherrin had a temperature, was coughing and had another seizure. He called me up and recommended sending her to the ER for a check-up. Sherrin sustained a TBI 15 months ago and is currently undergoing rehabilitation. Her cognitive skills are good, but she still requires extensive physical therapy . In December 2012 a Baclofen Pump was inserted into her body to help control spacisity. Two days earlier, on Tuesday August 13th, her Backlofen pump had been refilled and apparently the Doctor that was adjusting it failed to program it correctly and, as a direct result, Sherrin got double the dose. In other words she over dosed. As a result of this mistake she had another seizure and was immense pain. Upon arrival she was admitted into the ICU.

If you can prove that the doctor negligently caused the overdose by incorrectly adjusting the pump, then you may have reason to investigate a medical malpractice case. The question is whether Sherrin suffered permanent harm as a result of the overdose. Medical malpractice cases are very time consuming and expensive, and to be financially viable there has to be sigificant harm from a medical mistake. The articles below explain this in more detail.
