QUESTION

Potential HIPPA violation...?

Asked on Jun 11th, 2014 on Medical Malpractice - New York
More details to this question:
I have been seeing the same therapist for 4 years. He unfortunately moved out of the country, leaving the medical group to find new therapists. Within the past few months, this therapist has done nothing but bash the other doctor that has been seeing me for years. My mother and I do not get along to say the least, and when I went in to his office today, he told me that he had called my mother (whom is my emergency contact) and my uncle who is greatly attached to the mental health field. I never gave my doctor any type of permission to speak with either one of them, but because of his discussion with my mother, and an opionion from another mental health patient (whom I used to be friends with, and wanted to find a way to get to me), he's labeled me as an addict and that I need to be put in in-patient (like my mother has always wanted). I am absolutely furious and want something done with this therapist. He thinks he can change the world along with people's prescribed medications that have been on them for years. He was absolutely disrespectful, and was basing his own opinions on what other people (whom dont like me in the first place) have to say. Please contact me if there is any type of potential case here. Thank you.

Thank you for contacting us and I am sorry to hear about your situation. Certainly you must feel violating that your personal information was communicated to other family members without your permission (assuming you are a non dependant). Since this is such a specific part of medical malpractice (I would label this as "psychological malpractice"), the best step you could take is contract a psychological malpractice attorney in NY. They will be most familiar and able to help with this issue. Hope this helps, Dr. Guy Regev.
