QUESTION

Proving a hospital performed below standard

Asked on Dec 20th, 2013 on Medical Malpractice - Illinois
More details to this question:
On June 27, 2013 my grandfather went to the hospital for heart surgery but had confusion and agitation following anesthetic. He had a sitter, was restrained at times post op, and put on sedatives. When in the rehab unit they left him in bed unattended and the bed alarm did not go off and he fell out of bed resulting in a broken pelvis. We think he should not have been left unattended. we have had to build a wheelchair ramp and rent medical equipment because of the broken pelvis he is now in a wheelchair. The doctor wanted him to have hip surgery in Jan. to repair the socket. He could not do PT to help him walk again because his dementia is worse since surgery and he is too weak. The hospital says I need to have a doctor state that the hospital acted below standard level of care.

This appears to be a potentially viable medical malpractice claim.  Hospitals and nursing homes have a duty to perfrom fall risk assessments for each patient and take appropriate measures to protect patients that are at a high risk of falls.  Bed alarms are just one of the ways this can be done.  We have handled several of these cases in the past and would be happy to discuss your claim with you in more detail.  Nick Deets Nick Deets HOVDE DASSOW + DEETS, LLC Meridian Tower| 201 W. 103rd Street Suite 500| Indianapolis, IN  46290 Telephone:  (317) 818-3100| Facsimile:  (317) 818-3111 Email: ndeets@hovdelaw.com Website:  www.hovdelaw.com
