QUESTION

Should I get a second opinion on a medical malpractice case?

Asked on Oct 05th, 2012 on Medical Malpractice - Missouri
More details to this question:
My mother died from final stage colon cancer. I had a lawyer to look at my case but they said that there was nothing that they could do. My mother has a few colonoscopies where there have been polyps. In 2009 or 2010 was the last colonoscopy where a polyp was removed and she was scheduled for another exam in five years, which would be 2014. I believe that if she was having polyp growth, she should have been checked yearly. I also believe that african americans should have more colonoscopies due to being more at risk to diseases than caucasions. I just want to know if I sould get a second opinion?

Check out the article here, which discusses the standard of care regarding screening after finding polyps, about half way down the article. How soon your mother should have come back depends on the characteristics of the polyps that they removed. You wold have to look at the pathology reports generated when they removed the polyps, and see if they possessed characteristics that warranted a quicker return.  Below are some articles you may find helpful.  They are written for a New Jersey audience (where I practice) but the ideas discussed in these articles usually apply in most other jurisdictions as well.
