When m third toe started curling up, I decided to see another Dr. The 2nd podiatrist diagnosed me with a 2nd metatarsal dislocation and something else with my big toe joint. The dislocations got worse creating hammer toes. NOT torn cartilage and a neuroma. I didn't have a neuroma at all. I had to have a difficult surgery after ruining my foot as a mailman based upon my initial diagnosis. I continued to walk 6-9 miles daily not knowing what was really wrong with my foot for an entire year. This surgery involved 6 screws and a plate which will put me out of work for 12 wks.MY feet are MY livelihood.
If the subsequent providers you saw will state that, to a reasonable degree of medical certainty, the original provider's evaluation and treatment were below the standard of care in the community, then you would have a case (although I cannot address whether you would be successful or not due to the myriad of other factors involved).
